Open Question: Who pays to repair the faulty sewer in this purchase of a used condominium?
Condominium Owner puts his condo up for sale via a real estate agent (the “Listing Agent”) who lives 6 condos away in the same condominium complex. Condo Owner moves out of state, leaving his condo to be showcased and sold by the Listing Agent who has full access to the condo and can report to the owner any needs for upkeep the seller cannot immediately see. .

One year passes without a buyer for the property materializing. During this time, roots from a tree outside the condo grow into the condo’s sewer, partially blocking the ability of one toilet to flush. None of the other condos surrounding this unit (attached town homes) experience sewer blockages.

A different real estate agent (the “Buyer’s Agent”) brings the condo to a new buyer from out of town. The Buyer’s Agent shows the new buyer the property and no sewer problems are mentioned nor are apparent at that time. The Buyer makes a bid which is accepted. A Home Inspector is called in to inspect pursuant to the terms of the Buyer’s mortgage. The Home Inspector flushes the blocked toilet ONCE and no problems are seen. The buyer then closes on the purchase/sale and moves in.

Then after a few flushes, the toilet backs up and floods the downstairs in the first week that the buyer has moved in. The cost to repair the toilet is expensive in that it requires scoping the sewer pipes, digging and replacing the blocked portions. The bill is $3000.

Who does the buyer have LEGAL RECOURSE TO in order of who is most reponsible for selling him a home with a faulty sewer no-one told him about:

A. The Seller
B. The Listing Real Estate Agent
C. The Buyer’s Real Estate Agent
D. The Home Inspector
E, No-one (i.e. “Buyer Beware”)
